1. Introduction

Gorge LLC ("Gorge," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your personal information when you use the Gorge platform, including our website at https://eatgorge.com.

This policy applies to all users of the Gorge platform, including customers and vendors. By using the Platform, you consent to the data practices described in this policy.

2. Information We Collect

2.1 Information You Provide Directly

Create an account: full name, email address, password (stored in encrypted form — we never see your plaintext password).

Place an order (customers): order details (items, quantities, special instructions); payment card information (collected and processed by Stripe — Gorge does not store full card numbers); pickup preferences.

Register as a vendor: business name and description; owner name; phone number; business address and operating location; cuisine type and menu information; business photos; bank account information (collected by Stripe for payouts — not stored by Gorge); permit and license information.

2.2 Information Collected Automatically

When you use the Platform, we automatically collect device information (device type, OS, browser), IP address and approximate location, pages visited and features used, order history and interactions, session duration and timestamps, and crash reports and error logs.

3. How We Use Your Information

We use your information to operate the Platform (accounts, orders, payments, confirmations, support); improve our service (usage analysis, debugging, new features); communicate with you (transactional emails, policy updates, marketing only with consent); and for safety and compliance (fraud prevention, enforcing our Terms and Conditions, legal obligations, law enforcement requests).

4. Legal Basis for Processing (California Residents)

If you are a California resident, the CCPA/CPRA give you specific rights. We process information based on: performance of a contract; legitimate interests (improvement, fraud prevention); legal obligation; and your consent for marketing.

5. How We Share Your Information

5.1 With Vendors (for customers)

When you place an order, we share your first name, order details (items, quantities, special instructions), and order number. We do not share your email address, payment information, or full name with vendors unless necessary for order fulfillment.

5.2 We Do Not Sell Your Data

Gorge does not sell, rent, or trade your personal information to third parties for their own marketing purposes.

6. Data Retention

Account information is retained for the lifetime of the account, plus 90 days after deletion. Order history is retained for 7 years (tax and financial records). Server logs are retained for 90 days.

7. Your Rights

California residents may have the right to know, delete, correct, opt out of sale/sharing (we do not sell data), and non-discrimination. To exercise these rights, contact legal@eatgorge.com. We will respond within 45 days.

8. Data Security

We use HTTPS, hashed passwords, Stripe for PCI-compliant payments, restricted database access, and ongoing security review. No method of transmission or storage is 100% secure.

9. Children's Privacy

The Platform is not intended for anyone under 18. We do not knowingly collect information from minors. Contact legal@eatgorge.com if you believe we have collected a minor's information.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE GORGE PLATFORM. BY CREATING AN ACCOUNT OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THESE TERMS.

1. About Gorge

Gorge LLC ("Gorge," "we," "us," or "our") operates a digital marketplace platform available at https://app.eatgorge.com that connects customers with independent street food vendors operating in Los Angeles and surrounding areas. Gorge is a technology platform only — we do not prepare, cook, sell, or deliver food.

2. Acceptance of Terms

By accessing or using the Platform, creating an account, placing an order, or registering as a vendor, you confirm that you are at least 18 years of age, have read and agree to these Terms, and agree to our Privacy Policy.

3. The Gorge Platform

Gorge is an online ordering platform that allows customers to place advance orders and pay securely, notifies vendors of incoming orders in real time, provides order tracking and status updates, and processes payments on behalf of vendors via Stripe. Gorge is not responsible for the actions, quality, or compliance of any vendor.

5. Placing Orders (Customers)

An order is not confirmed until the vendor explicitly accepts it. All orders on Gorge are currently pickup-only. You are responsible for collecting your order at the vendor's stated location within a reasonable time after the vendor marks it as ready. Gorge is not responsible for orders that go uncollected.

Allergies and Dietary Requirements

Gorge does not verify or guarantee that vendors can accommodate dietary restrictions, food allergies, or intolerances. It is your sole responsibility to check with the vendor regarding ingredients and preparation methods before ordering. If you have a serious food allergy, please speak directly with the vendor before ordering.

6. Payments

All payments on the Gorge platform are processed by Stripe. Gorge charges a service fee of up to 10% on each order. Refunds are processed when a vendor declines your order, or when an order is auto-cancelled due to vendor non-response. To request a refund, contact us at legal@eatgorge.com within 24 hours of the order.

7. Vendor Terms

Vendors must hold all required permits and licenses for their jurisdiction. Gorge charges vendors a commission of 10% on each completed order. Vendors are independent contractors, not employees, agents, or partners of Gorge. Gorge may suspend or terminate vendor accounts for repeated declines or non-responses, food safety or quality complaints, failure to maintain permits, or violation of these Terms.

10. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. GORGE IS A TECHNOLOGY PLATFORM ONLY AND IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, LEGALITY, OR ACCURACY OF FOOD SOLD BY VENDORS. YOU CONSUME FOOD ORDERED THROUGH GORGE AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

11. Dispute Resolution

Disputes not resolved informally shall be resolved by binding individual arbitration under AAA rules. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. These Terms are governed by the laws of the State of California.
